1. Acceptance of Terms

By downloading, accessing, or using the Haven mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Haven is a mobile application that provides information about happy hour deals, promotions, and specials at restaurants, bars, and other venues. The App offers the following features:

• Discovery of happy hour deals and specials at local venues
• Interactive map showing nearby venues and their offerings
• Ability to save favorite venues to a personal watchlist
• Push notifications about deals and updates (with your permission)
• Gamification features including check-ins, badges, and rewards tiers
• User profiles with customizable photos and preferences
• Sharing functionality for deals and venues

3. User Accounts and Authentication

Some features of the App require you to create an account. We offer multiple authentication methods including Google Sign-In, Apple Sign-In, and email magic links. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

You agree to:

• Provide accurate and complete information when creating your account
• Update your information to keep it current
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with others
• Use only one account per person

4. Gamification and Rewards Program

The App includes a gamification system ("Happy Hour Passport") that rewards users for engaging with the platform. By participating, you agree to the following:

• Check-ins require you to be physically present at the venue within a specified radius
• Badges and tier progression are earned based on legitimate activity only
• We reserve the right to revoke points, badges, or tier status for fraudulent activity
• Rewards and tier benefits may change at our discretion
• Check-in streaks and bonuses are subject to verification

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Submit false, misleading, or inaccurate information
• Fake check-ins or manipulate the gamification system
• Interfere with or disrupt the App or its servers
• Attempt to gain unauthorized access to any portion of the App
• Use the App to harass, abuse, or harm others
• Scrape, harvest, or collect user data without permission
• Upload inappropriate, offensive, or copyrighted content as profile photos
• Impersonate another person or misrepresent your affiliation

6. Content and Information Accuracy

Deal information, hours, prices, and other venue details displayed in the App are provided for informational purposes only. While we strive to keep information accurate and up-to-date, we cannot guarantee the accuracy, completeness, or timeliness of any information. Venues may change their offerings without notice. We strongly recommend confirming deal details directly with venues before making plans based on information in the App. Haven is not responsible for any discrepancies between displayed information and actual venue offerings.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Haven and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks, logos, and service marks may not be used without our prior written consent.

8. User-Generated Content

If you submit content to the App (such as profile photos, reviews, or corrections), you:

• Grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display that content in connection with the App
• Represent that you own or have the right to submit such content
• Agree not to submit content that infringes on third-party rights
• Understand that we may remove content that violates these Terms

9. Third-Party Services

The App integrates with and relies on third-party services to provide its functionality:

Authentication Services

We use Google Sign-In and Apple Sign-In for account authentication. Your use of these services is subject to their respective terms and privacy policies.

Maps and Location

We use Google Maps to display venue locations and calculate distances. Your use of map features is subject to Google Maps Terms of Service.

Cloud Services

We use Firebase (Google Cloud) for data storage, authentication, and analytics. Your data may be processed according to Google Cloud Platform Terms of Service.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAVEN AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION; (D) ANY BUGS, VIRUSES, OR SIMILAR ISSUES; OR (E) ANY ERRORS OR OMISSIONS IN ANY CONTENT.

12. Indemnification

You agree to defend, indemnify, and hold harmless Haven and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the App.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination: (a) your right to use the App will immediately cease; (b) we may delete your account and all associated data; (c) any accumulated points, badges, or tier status will be forfeited.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hamilton County, Ohio, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
